GENERAL REGISTRATION AGREEMENT
This Registration Agreement ("Agreement") sets forth the terms and conditions of your use of
LYRegistry
Domain name registration services to register an Internet Domain name, as well as your registration of that
Domain name.
The
registration process will only be completed when you acknowledge that you have read, understood, and agree to be bound by all
the terms and conditions of this Agreement. This Agreement will become effective when accepted by
LYRegistry
who may accept or reject your
Domain name registration application for any reason whatsoever, at its sole discretion.
1. Our role
LYRegistry is an accredited registrar
for a number of Top-Level-Domains (T.L.D's). As an accredited
Domain name registrar,
LYRegistry is your sponsor for that application.
Domain name registrations are not effective until
the registry administrator for the corresponding Registry puts into effect your
Domain name registration. By agreeing to the terms and conditions
of this Agreement, you are also agreeing to be bound by the rules and regulations set forth by
each registry administrator for his TLD.
You agree and acknowledge that
LYRegistry is not liable or responsible for any errors,
or eventual omissions or any other actions by the registry administrator of any
TLD, including the failure to receive your
Domain name registration.
You further agree to indemnify, defend and hold harmless the registry administrator and its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of, or related to, your
Domain name registration.
2. Fees
Registration fees are payable upon application by credit card (or by any other
mean acceptable to LYRegistry). Please check our "Payment
Policy". These registration fees are not refundable, in
whole or in part, even if the Domain name registration is suspended, cancelled
or transferred prior to the end of the current registration term.
In the event of a Domain name deletion
due to non-payment by the Credit Card Company, the registration fees remain due
and payable. Reinstating charges are currently $250 in addition to the
registration fees. You
may view the current rates for registering a Domain name or the service charges
on LYRegistry
web site. LYRegistry reserves the right to change fees,
service fees, renewal fees or to institute new fees at any time, at its sole discretion. You will be notified prior to when a renewal fee is due. Should a renewal fee go unpaid within the time specified,
your registration will be cancelled, but you will still be liable for the fees.
3. Transfer of Ownership
The entity named as the registrant contact at the time of applying for
registration shall be the depositor (commonly known as the owner of the
Domain name). Prior to
any transfer of ownership of a
Domain name to another entity, the then-current amount set for this transfer
should be paid for, together with the new registration fees. The current owner
is responsible for these charges. The
Transferee (new potential owner) must agree in writing to be bound by all terms and conditions of this Agreement.
The
Domain name will not be transferred until we receive such written assurances, and actual payment of the transfer fees. You
agree that should you attempt to transfer your
Domain name registration without paying LYRegistry the then-current amount set for the transfer of ownership of a Domain name,
any such transfer will be null and void, and will result in your
Domain name registration being revoked without a refund.
4. Dispute Policy
Registering a Domain name does not confer any legal rights to that name and any
disputes between parties over the right to use a particular name are to be
settled between the contending parties using normal legal methods (see RFC 1591,
ftp://rs.internic.net/policy/rfc1591.txt). The
applicant agrees that if the use of the Domain is challenged by any third party,
or if any dispute arises under this Registration Agreement, as amended, the
applicant will abide by these terms and conditions.
5. Changes to Registration Agreement and Dispute Policy
The Domain name system and the practice of registering and administering
Domain names are evolving, and therefore you agree that LYRegistry may modify this Agreement if necessary
as to adjust to changing business circumstances. Your continued use of the
Domain name registered to you shall constitute your acceptance of this Agreement
with the new modifications. If you do not agree to any of such changes, you may request that your
Domain name registration be cancelled or transferred to a different Domain name registrar.

6. Use of Registration
Information You agree and acknowledge that
LYRegistry will make available domain name registration information you provide
to
the LY registry administrator(s), and to other third parties and applicable laws may require or permit.
You further agree and acknowledge that
LYRegistry may make publicly available, or directly available to third party vendors, some, or all, of the
Domain name registration information you provide, for incorporation in the
Directory (WHOIS services) or for targeted marketing and other purposes.
LYRegistry will take reasonable precautions
as to protect the information it obtains from you.
You agree that if you license the use of the Domain name to a third party, you remain
responsible for all obligations under this Agreement.
You implicitly accept
to receive promotional e-mails from Lyregistry.com or any connected, affiliated
or related Company.
7. Limitation of Liability
You acknowledge and agree that
LYREGISTRY
will in no case be liable for:
a) any
suspension of the Domain
b) any loss of
your registration
c) any eventual
interruption of business
d) access
delays to your site
e) access
interruptions to your site f)
non-delivery, mis-delivery, corruption, delays, destruction, modification of
data
g) any event
beyond the control of LYREGISTRY
h) any case of
"force majeure".
8. Warranties
You confirm that, the registration of the
Domain name nor the manner in which it is, or will be used, infringes the legal rights of a third party. 9.
Suspension, Deletion
LYRegistry.com reserves the right to suspend, cancel,
delete, transfer or modify your
Domain registration if
a) you breach this Agreement,
b) you use your
Domain for an unlawful activity,
c) for any other
reason that Lyregistry thinks is necessary,
LY registry
is not responsible for checking the applicant's
rights to use any name and it is up to the applicant to ensure that he is not
infringing any registered trademarks. LYRegistry will obey
any legal order and reserves the right to suspend use of any Domain.
10. Governing Law
The LY-Registry
agreement is governed in all respects by and construed in accordance with international laws, without respect to its conflict of law rules.
This
registration agreement is not the complete and exclusive agreement of the applicant
and the ("parties"), Additional rules and regulations regarding each particular TLD might
place additional conditions. However,it supersedes, and its
terms govern, all prior proposals, agreements, or other communications between
the parties. Otherwise set forth, any action to enforce this Agreement or any matter relating to your use of the
LYRegistry site shall be brought exclusively in the country where
LYRegistry
decides.
11. Notices
You agree that any notices required to be given under this Agreement by
LYRegistry will be deemed to have been given if delivered in accordance with the contact information
provided at time of application.
12. General
Nothing contained in this Agreement shall be construed as creating any agency, partnership, or other form of joint enterprise between the parties.
The term "LYRegistry"
used in this Agreement means the Company in charge of the LYRegistry.com
and LYRegistery.LY
registration web sites.
This Agreement may not be amended or modified
except by means of a written document signed by both yourself and an authorized representative of
LYRegistry.
